Your contract with Kite Junkies Ltd (UK)  is for the provision of a booking with Kite Junkies (Egypt). Once this booking is made you do not have a contract with Kite Junkies (UK), but with the third party supplier Kite Junkies (Egypt).  Kite Junkies Ltd (UK) is merely a booking agent facilitating the contract between you and the supplier, Kite Junkies (Egypt).

Kite Junkies Ltd (UK)  responsibility is to make arrangements for the provision by the relevant supplier, but it does not have any responsibility for the service provided.

Kite Junkies Ltd (UK)   has no liability to you for any dissatisfaction, loss of enjoyment, loss, injury or damage which results from your use of the arrangements booked with Kite Junkies Ltd (UK), fFurther, Kite Junkies Ltd (UK)   has no liability to you in any event for any consequential loss which you may suffer in relation to any arrangements which you book to coincide with the arrangements you have booked with Kite Junkies Ltd (UK)  

Please note, in the unlikely event of our collapse/insolvency, any money you have paid is not protected by a scheme of financial protection. If this is important to you, we recommend you obtain suitable travel insurance.

The Privacy Policy, is part of this Kitejunkies Terms and Conditions and are only visually separated to make it easier for you to read.

Your use of the kitejunkies.com website and/or use of Kitejunkies, products or services signifies your acceptance of these Terms and Conditions and constitutes a legally binding acceptance of this agreement. LIABILITY RELEASE AND ASSUMPTION OF RISKFOR KITEBOARDING AND WATERSPORTS ACTIVITIES I declare hereby that I am aware of the inherent hazards of kitesurfing, kiteboarding and other activities involving the use of traction kites and I am a competent swimmer. I understand that kiteboarding, kite flying, any use of traction kites on land or on water, wakeboarding, sailing and any other water sports activities involves certain inherent risks. Serious injuries can occur that requires treatment in a hospital. I further understand that this activity may be conducted at a site that is remote, either by time or distance or both, from such facility. I still choose to proceed with such activity in spite of the possible absence of such facility in proximity to the site.

I understand and agree that neither my supervisor(s), assistant(s),instructor(s) nor Colona Watersports/ Kitejunkies Ltd , Regency Plaza Resort, nor International Kiteboarding organization (IKO), any equipment manufacturer nor its affiliate or subsidiary corporations, nor any of their respective employees, officers, agents or assigns, (hereafter referred to as ”Released Parties”) may be held liable or responsible in an y way for any injury, death, or other damages to me or my family, heirs, or assigns that may occur as a result of my participation in this activity, whether foreseen or unforeseen, or as a result of product liability or the negligence of any party, including the Released Parties, whether passive or active.

In consideration of being allowed to participate in this activity, I hereby personally assume all risks in connection with said activities, for any harm, injury or damage that may befall me while I am participating in this activity, including all risks connected therewith, whether foreseen or unforeseen.

I further save and hold harmless said course and Released Parties from any claim or lawsuit by me, my family, state, heirs, or assigns, arising out of my enrolment and participation in this activity including both claims arising during the activities or afterwards.

I also understand that kiteboarding, kite flying, wakeboarding, sailing and any other water sports activities are physically strenuous activities and that I will be exerting myself during this activity, and that if I am injured as a result of a heart attack, panic, hyperventilation, etc., that I expressly assume that risk of said injuries and that I will not hold the above listed individuals or companies responsible for the same.

I further state that I am of lawful age and legally competent to sign this liability release, or that I have acquired the written consent of my parent or guardian.

I understand that the terms herein are contractual and not a mere recital and that I have signed this document of my own free act.

I understand and agree that the equipment storage offered by KiteJunkies and Colona Watersports Ltd. is on my own risk and that Kite Junkies and Colona Watersports and the Regency Plaza Resort are not responsible for any lost or damaged equipment.

HEREWITH I UNDERSTAND AND AGREE THAT COLONA WATERSPORTS LTD., KITE JUNKIES, REGENCY PLAZA RESORT, INTERNATIONAL KITEBOARDING ORGANISATION (IKO) AND ALL RELATED ENTITIES AS, OFFICERS, AGENTS OR ASSIGNS MAY NOT BE HELD LIABLE OR RESPONSIBLE IN ANY WAY FOR ANY INJURY, DEATH OR OTHER DAMAGES TO ME OR MY FAMILY. I FURTHER SAVE AND HOLD HARMLESS SAID ACTIVITY AND RELEASED PARTIES FROM ANY CLAIM OR LAWSUIT FOR PERSONAL INJURY, PROPERTY LOSS OR DAMAGE, OR WRONGFUL DEATH, BY ME, MY FAMILY, ESTATE, HEIRS, OR ASSIGNS, ARISING OUT OF MY PARTICIPATION IN THIS ACTIVITY, INCLUDING BOTH CLAIMS ARISING DURING THE ACTIVITY OR AFTER I COMPLETE THE ACTIVITY.

There is no substitute for medical advice. You should consult your physician or other trained medical personnel before starting any, sport program. Colona Watersports/Kite Junkies is not engaged in rendering medical advice or diagnosis. Any medical decisions should be made in consultation with your physician or other trained medical personnel. We will not be liable for any complications, injuries, loss, or other medical problems arising from, or in connection with, the use of equipment or participation in classes.

I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS CERTIFICATE OF UNDERSTANDING BY READING IT BEFORE I PURCHASE ANY SERVICE FOM KITEJUNKIES . BY MAKING A PURCHASE I DECLARE MY ACCEPTANCE ON BEHALF OF MYSELF AND MY HEIRS.

Jurisdiction

The laws of the republic of Egypt govern this agreement, without giving effect to conflict of laws provisions. The courts of the Republic of Egypt have exclusive jurisdiction over all disputes relating to or arising from the execution or performance of this agreement unless Kitejunkies wishes to initiate legal proceedings in your home legal district. In all judicial actions, arbitrations, or disputes resolution methods, the parties waive any punitive damages.
